Variations of proposals made last year by Rep. Bill Pascrell (D-Paterson) are suddenly back in the news on Monday morning.

House Speaker Nancy Pelosi said that she would consider invoking the 14th Amendment of the U.S. Constitution to expel Members of Congress who have “engaged in insurrection or rebellion” against the United States.”

In December, Pascrell first proposed preventing congressmen who signed on to a lawsuit to prevent the certification of Joe Biden as the winner of the 2020 presidential from being sworn into the U.S. House of Representatives.   He cited the 14th Amendment.

One New Jersey representative, Jeff Van Drew (R-Dennis), signed on to the lawsuit to challenge the election.

Pascrell filed legal complaints in November in a bid to disbar Rudy Giuliani and nearly two dozen other lawyers working for President Donald Trump for filing lawsuits to overturn the election results.

The New York State Bar Association announced today that they have launched an inquiry to decide if Giuliani should be disbarred.

Scott Karson, the bar association president, cited a section of the bylaws that says “no person who advocates the overthrow of the government of the United States, or of any state, territory or possession thereof, or of any political subdivision therein, by force or other illegal means, shall be a member of the Association.”

“Mr. Giuliani’s words quite clearly were intended to encourage Trump supporters unhappy with the election’s outcome to take matters into their own hands,” Karson said in a statement today.  “Their subsequent attack on the Capitol was nothing short of an attempted coup, intended to prevent the peaceful transition of power.”
